An easement is a permanent property right registered against the title, typically paid as a one-off capital lump sum. It differs from a temporary agreement which can be terminated. Converting a pre-existing right into an easement can crystallise significant value for a developer.
Where an existing right can be terminated, notice can be served requiring the operator to remove or divert the apparatus. The operator may seek statutory rights or apply for compulsory powers, but the process creates strong leverage in the negotiations. We manage that process from start to finish.
